RELEASE AND WAIVER OF LIABILITY AND INDEMNITY (“Release Agreement”)

This is a release and waiver of liability and indemnity. Please read carefully.

BY ENTERING AND USING THIS FACILITY, I am agreeing to this release and waiver of liability and indemnity.

19^th Hole Indoor Golf & Social inc.

In consideration for being allowed to use the indoor golf simulator facility and related equipment provided by 19^th Hole Indoor Golf & Social, the undersigned, hereinafter referred to as “Participant,” agrees to the following terms and conditions:

Assumption of Risk:

Participant acknowledges and understands that the use of the indoor golf simulators & Race Simulators involves inherent risks, including but not limited to the risk of injury from golf swings, falls, and equipment use.

Release and Waiver

Participant hereby releases, discharges, and agrees not to sue Company, its owners, employees, agents, and affiliates from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, or injury, including death, that may be sustained by Participant while participating in the activities provided by Company.

Medical Condition:

Participant affirms that they are in good physical condition and have no medical conditions that would prevent safe participation. It is the responsibility of the Participant to consult with a physician before engaging in any physical activity.

Rules and Regulations:

Participant agrees to comply with all rules and regulations of 19th Hole Indoor Golf & Social. Failure to adhere to these rules may result in expulsion from the facility.

Release and Waiver:

Participant releases and discharges 19th Hole Indoor Golf & Social, its owners, employees, agents, and affiliates from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, or injury, including death, that may be sustained by Participant while using the facility.

Insurance:

Participant acknowledges that 19th Hole Indoor Golf & Social does not provide insurance coverage for injuries or losses sustained while using the facility. Participant is encouraged to obtain personal insurance coverage as deemed necessary.

Photography and Publicity:

Participant grants 19th Hole Indoor Golf & Social the right to use, without compensation, any photographs, videos, or other recordings taken during the use of the facility for promotional or marketing purposes.

Minor Participants:

If the Participant is a minor, the undersigned parent or legal guardian agrees to the terms on behalf of the minor and assumes all responsibilities and obligations herein.

Governing Law:

This agreement shall be governed by and construed in accordance with the laws of The Halton Region. Any legal action or proceeding arising out of or related to this agreement shall be brought exclusively in the courts of the Halton Region.
